My (latest) opinion (IANAL): Absent a contractual requirement, the software should be unbundleable (to make up a word). Two things:

  • when (i.e., which version of Windows) did a contractual requirement become part of the EULA, and
  • if such a requirement is now part of the EULA, is it legal / enforceable? (Will it be upheld by the courts? -- I'd have to go back and follow some of the listed links, but hasn't the requirement already been struck down in some cases, like Softman v. Adobe?)
